This Intellectual Property Claim Policy outlines how individuals or rights holders may report the misuse of their intellectual property on our website or through our services.

2. What Qualifies as an Intellectual Property Violation?

You may submit an IP claim if you believe your protected intellectual property has been:

  • Sold without rights
  • Misrepresented
  • Offered in a counterfeit form

Examples include:

Copyright Violations

  • Product images copied from another source
  • Artwork or graphics used without permission
  • Descriptions or text copied from another website
  • Original product designs replicated without consent

Trademark Violations

  • Unauthorized use of your brand name
  • Use of a confusingly similar name
  • Counterfeit goods using your mark
  • Use of your registered logo without permission

Other IP Violations

  • Unauthorized sale of proprietary products
  • Misuse of protected packaging designs
  • Imitation of custom product designs
  • Use of protected digital content

3. How to Submit an Intellectual Property Claim

To file an Intellectual Property Claim, send an email to:

Subject Line: Intellectual Property Claim – [Your Name / Company]

Your claim must include the following required information:

A. Contact Information

  • Full legal name
  • Company name (if applicable)
  • Mailing address
  • Phone number
  • Email address

B. Identification of the Intellectual Property

Provide one or more of the following:

  • Copyright registration number
  • Trademark registration number
  • Proof of ownership (portfolio link, original files, date stamps, etc.)
  • Images, URLs, or documents showing proof of original creation
  • Additional verification materials (if needed)

C. Description of the Infringing Content

Include:

  • The exact URL(s) from our website
  • Description of the unauthorized use
  • Screenshots or visual examples (optional but helpful)

D. A Formal Declaration

Your claim must include the following statements:

  1. “I have a good-faith belief that the use of the material described is not authorized by the intellectual property owner, its agent, or the law.”
  2. “The information in this claim is accurate, and I am the intellectual property owner or authorized to act on behalf of the owner.”
  3. “I understand that submitting false or misleading claims may result in legal consequences.”

E. Signature

  • Physical signature, or
  • Electronic signature (typed full legal name)

Incomplete IP claims may be rejected until all required information is provided.


4. What Happens After You Submit a Claim

Once we receive your IP claim:

  1. We will review the claim within 3–5 business days
  2. We may temporarily remove or disable access to the content under review
  3. We may contact you for more information or clarification
  4. We will notify the seller or content uploader regarding the claim
  5. If appropriate, the content may be permanently removed
  6. If needed, we may request additional documentation

We take all claims seriously and evaluate them on a case-by-case basis.


5. Counter-Notification Process

If content is removed due to an IP claim, the person who posted the content may submit a Counter-Notification if they believe the claim is incorrect.

To submit a counter-notification, they must provide:

  • Full legal name and contact details
  • Identification of removed content
  • A statement explaining why the removal was an error
  • Evidence of ownership or authorization
  • A declaration consenting to U.S. jurisdiction for legal disputes
  • Their electronic or physical signature

Once a valid counter-notification is received, we will:

  • Forward the counter-notification to the original claimant
  • Allow the claimant 10–14 business days to file legal action
  • Restore the content unless we receive notice of a court order

6. Repeat Infringer Policy

To maintain compliance with legal requirements and to protect intellectual property owners, we may:

  • Remove or disable content belonging to repeat offenders
  • Restrict account privileges
  • Terminate access to Rizoron services
  • Block listings or products
  • Prevent further uploads

Determination of repeat infringement is at our discretion.


7. False Claims & Abuse of IP Reporting

Submitting false, misleading, or fraudulent IP claims violates this policy and may result in:

  • Account suspension
  • Permanent banning
  • Reporting to legal authorities
  • Civil liability for damages

We encourage all claimants to verify ownership before filing a report.
